Contractor EPF Coverage

About Contractor Employee EPF Service

Under the EPF & MP Act, 1952, contract employees (including those engaged through contractors) are eligible for EPF benefits if they meet the criteria (employee count, wages, etc.). The responsibility for EPF compliance may fall on the contractor, but in case of default, the principal employer is held liable. This creates complex situations for workers, contractors, and principal employers. Our service helps all parties understand their rights and obligations, ensure timely contribution deposits, resolve disputes, and enable contract workers to access their PF benefits.

📌 Key Legal Provisions:
• Section 2(f) – Definition of "employee" includes contract workers.
• Section 8A – Principal employer liable if contractor defaults.
• Form 5A – Registration of establishments with contractors.
• EPFO circulars on contractor coverage – contractors must register separately.

Frequently Asked Questions on Contractor Employee EPF

Are contract workers eligible for EPF benefits?
Yes, contract workers are considered "employees" under the EPF Act. If the contractor employs 20 or more persons (or if principal employer's establishment meets the threshold), contract workers are covered. Even if the contractor is smaller, they may be covered under the principal employer's coverage.
Who is responsible for depositing EPF for contract employees?
The contractor is primarily responsible. However, if the contractor defaults, the principal employer becomes liable for the dues. EPFO can recover from the principal employer.
How can a contract worker check if PF is being deposited?
You need a UAN. If the contractor has not provided one, we help you trace your PF account or file a complaint to get coverage. Once UAN is available, you can check passbook for contributions.
What if the contractor has not registered under EPF?
We can help file a complaint with EPFO against the contractor and principal employer for non-registration and non-deposit of contributions. EPFO can initiate proceedings under Section 7A and recover dues.
Can a contract employee withdraw PF while still working?
Yes, contract employees have the same rights as regular employees – they can apply for partial withdrawal (advance) for specified purposes and full withdrawal after leaving the job/contract.
